Subdivision of Land

The subdivision of land refers to the division of a parcel of land into two (2) or more lots, parcels, sites, units, plats, or interests for the purpose of offer, sale, lease, or development, either on the installment plan or upon any and all other plans, terms, and conditions, including resubdivision.  Subdivision includes the division or development of land zoned for residential and non-residential uses, whether by deed, metes and bounds descriptions, devise, intestacy, lease, map, plat or other recorded instruments. 

The following outlines a typical process for the subdivision of land in the City of Franklin.

  1. Primary Plat / Sketch Plan Application

  2. Review by the Franklin Technical Review Committee (TRC)

  3. Review by the Franklin City Plan Commission (for compliance with the Franklin City Subdivision Control Ordinance & Zoning Ordinance)

  4. Review and approval of subdivision construction plans by the Department of Planning & Department of Engineering

  5. Submission of accurate "as-built" plans for the subdivision section.

  6. Secondary / Final Plat Application

  7. Review by Department of Planning Staff for substantial compliance with the approved primary plan

  8. Review and acceptance of any public improvements by the City of Franklin Board of Public Works and Safety

  9. Recording of the Plat with the Johnson County Recorder

The following are considered "exempt" subdivisions (subdivisions that are not required to proceed through the entire subdivision process)

  1. A division of land into two (2) or more tracts, all of which are at least five (5) acres in size;

  2. A division of land for the sale or exchange of tracts to correct errors in an existing legal description, provided that no additional building sites other than for accessory buildings are created by the division;

  3. A division of land pursuant to an allocation of land in the settlement of a decedent's estate or a court decree for the distribution of property;

  4. A division of land for the acquisition of street right-of-way or easement;

  5. A division of land for the sale or exchange of tracts between adjoining land owners, provided that no additional building sites other than for accessory buildings are created by the division; and

  6. A division of land into cemetery plots for the purpose of burial of corpses.
